HyperAura – Terms & Conditions

1. Definitions

  • “Services”: Web/app development, SEO, graphic design, AI automation.
  • “Client Materials”: Logos, content, or data provided by the client.

2. Engagement Process

  • Proposal: A signed Statement of Work (SOW) outlines all deliverables, timelines, and costs.
  • Revisions: Includes 2 free rounds of revisions. Additional changes billed at $95/hour.

3. Client Obligations

  • Provide feedback within 5 business days to avoid project delays.
  • Ensure all Client Materials are copyright-compliant.

4. Financial Terms

  • Deposit: 50% upfront for projects over $2,000.
  • Payment Methods:
    • Stripe: 3% processing fee
    • Bank Transfer: no fee
  • Late Payments: 1.5% monthly interest + suspension of services.

5. Intellectual Property

  • Pre-Payment: HyperAura owns all drafts and initial work.
  • Post-Payment: Client receives full rights, excluding proprietary tools.

6. Confidentiality

  • NDAs apply to all shared business strategies.
  • Data is stored on GDPR-compliant servers (AWS Canada/US).

7. Liability & Warranty

  • Warranty: 90-day bug-fixing support for websites.
  • Limitation of Liability: Maximum liability limited to the last 3 months’ fees paid.

8. Termination

  • By Client: 30-day notice required; all paid work will be delivered.
  • By HyperAura: Immediate termination for non-payment or harassment.

9. International Compliance

  • Taxes: Client is responsible for local VAT obligations.
    Example: EU clients handle reverse charge.
  • Disputes: Arbitration under Qatar Financial Centre (QFC) rules.

10. Force Majeure

Delays caused by the following are not the responsibility of HyperAura:

  • Cyberattacks
  • Sanctions
  • Natural disasters
  • Other events beyond reasonable control
